The short answer is yes. The long answer is that it’s a little tricky. The 2018 Farm Bill legalized hemp and hemp-derived products, including CBD. However, the bill did not explicitly address delta 8, delta 10, or HHC.
The DEA has issued an Interim Final Rule stating that all synthetically derived tetrahydrocannabinols (THCs) are Schedule I controlled substances, which includes delta 8 and delta 10 because of how they’re extracted from hemp. HHC is not specifically mentioned in the rule, leaving its legal status somewhat ambiguous.
Even though delta 8 and delta 10 are considered “synthetically derived” they are not actually synthetic, leaving them in a sort of legal gray area. A technical loophole in the Farm Bill has left these compounds legal, but that wasn’t the intention of the government upon legalizing hemp.
Although some states agree with the federal consensus and allow delta 8 to be sold, purchased, and used, some states have explicitly banned these compounds, while others have not addressed their legality.
